1. Acceptance of Terms

Welcome to Techtamu.com. These Terms of Service (“Terms”) govern your access to and use of the website, services, events, and applications provided by OpenKelas Enterprise (“we”, “us”, or “our”). By accessing or using Techtamu.com, registering for an account, or purchasing tickets for our events, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you must not access or use our services.

2. Definitions

In these Terms, the following definitions apply:

  • “Website” refers to Techtamu.com and any associated subdomains.
  • “Services” refers to the digital content, event listings, ticketing, classes, workshops, and community forums provided through the Website.
  • “User”, “You”, or “Your” refers to any individual or entity accessing the Website or registering for our events.
  • “Event” refers to any meetup, hackathon, workshop, class, or gathering organized or promoted by OpenKelas Enterprise.

3. Eligibility and Account Registration

To access certain features of the Website and register for Events, you may be required to create an account.

3.1 Eligibility

You must be at least 18 years of age and possess the legal capacity to enter into a binding contract under the Contracts Act 1950 of Malaysia. If you are under 18, you may only use the Website and register for Events with the explicit consent and supervision of a parent or legal guardian.

3.2 Account Security

You are responsible for maintaining the confidentiality of your account credentials. You agree to notify us immediately at [email protected] if you suspect any unauthorized use of your account. OpenKelas Enterprise shall not be liable for any loss or damage arising from your failure to comply with this security obligation.

4. Event Registration, Ticketing, and Payments

Techtamu.com serves as a platform to discover and register for various technology and community Events. All ticket sales and registrations are subject to the following conditions:

4.1 Booking and Payment

All ticket purchases are processed securely through our authorized third-party payment gateways. By completing a purchase, you warrant that the payment information provided is accurate and that you have sufficient funds or credit to cover the transaction. Ticket prices are listed in Malaysian Ringgit (MYR) unless otherwise stated, and are inclusive of applicable taxes where required by Malaysian law.

4.2 Cancellations and Refunds

Due to the logistical nature of our Events, all ticket sales are generally final. However, exceptions may apply:

  • Event Cancellation by Us: If OpenKelas Enterprise cancels an Event, you will receive a full refund to your original payment method.
  • Event Rescheduling: If an Event is rescheduled, your ticket will automatically be valid for the new date. If you cannot attend the new date, you may request a refund within 7 days of the reschedule announcement.
  • User Cancellation: Refunds for personal cancellations are strictly at the discretion of the organizers and are generally not provided unless explicitly stated in the specific Event’s terms.

5. User Conduct and Acceptable Use

You agree to use Techtamu.com only for lawful purposes and in accordance with the Communications and Multimedia Act 1998 of Malaysia. You agree NOT to:

  • Use the Website in any way that violates any local, national, or international law or regulation.
  • Transmit any material that is defamatory, obscene, offensive, discriminatory, or promotes illegal activities.
  • Attempt to gain unauthorized access to our servers, user accounts, or third-party payment systems.
  • Use automated systems, bots, or scrapers to extract data, ticket inventory, or user information from the Website.
  • Resell tickets for our Events at inflated prices (scalping) without our explicit written permission.

We reserve the right to suspend or terminate your account, cancel your Event tickets without a refund, and report you to the Royal Malaysia Police (PDRM) or relevant authorities if you violate these conduct rules.

6. Intellectual Property Rights

All content on Techtamu.com, including but not limited to text, graphics, logos, event modules, workshop materials, software, and trademarks (such as “Techtamu” and “OpenKelas”), is the exclusive property of OpenKelas Enterprise and is protected by the Copyright Act 1987 and the Trademarks Act 2019 of Malaysia. You may not reproduce, distribute, or create derivative works from our content without our prior written consent.

7. Disclaimers and Limitation of Liability

Your use of the Website and attendance at our Events are entirely at your own risk.

7.1 “As Is” Basis

The Website and Services are provided on an “as is” and “as available” basis. OpenKelas Enterprise makes no warranties, express or implied, regarding the uninterrupted availability of the Website, the accuracy of event details, or the suitability of the content for any particular purpose.

7.2 Limitation of Liability

To the maximum extent permitted by Malaysian law, OpenKelas Enterprise, its directors, employees, and partners shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities, arising out of your use of the Website or attendance at any Event. Our total liability to you for any claim arising out of these Terms shall not exceed the amount you paid us for the specific Event or Service in question.

8. Indemnification

You agree to indemnify, defend, and hold harmless OpenKelas Enterprise and its affiliates from any claims, liabilities, damages, losses, and expenses (including legal fees) arising out of or in any way connected with your access to or use of the Website, your violation of these Terms, or your infringement of any intellectual property or other rights of any third party.

9. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of Malaysia. Any disputes arising out of or in connection with these Terms, including any question regarding their existence, validity, or termination, shall be subject to the exclusive jurisdiction of the competent courts of Malaysia, specifically located in Cyberjaya, Selangor.

10. Modifications to the Terms

We reserve the right to modify these Terms at any time. Updated Terms will be posted on this page with a revised Effective Date. Your continued use of Techtamu.com or registration for future Events after such modifications constitutes your acceptance of the updated Terms.
